THE UGLY FLOOR CONTEST'S — FLOORING GIVEAWAY CONTEST 2010 OFFICIAL RULES — NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.
How to Enter: Beginning at 9:00 a.m. Eastern Time ("ET") on May 19, 2012 until 11:59 p.m. ET on August 31, 2012, you may enter the The Ugly Floor Contest in by the following method only: (i) online by visiting the TUFC website (www.theuglyfloorcontest.com) (the "The Ugly Floor Contest Website") and submitting your flooring picture after registration. Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All online entries must be received by 11:59:59 p.m. ET on August 31, 2012. These official rules are also available at the The Ugly Floor Contest Website. All eligible entries are able to be voted on.
When you enter at The Ugly Floor Contest Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming The Ugly Floor Contest promotions and information about TUFC and the Participating Product Contributors defined below. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Contest and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of The Ugly Floor Contest, which is available on the The Ugly Floor Contest Website. The Ugly Floor Contest ("Main Sponsor"), and all Participating Product Contributors defined below (collectively with Main Sponsor, the "Contest Entities"), their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the TUFC Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible or postage due, or any combination thereof. All entries become the property of The Ugly Floor Contest and the Main Sponsor.
Eligibility: This Contest is open only to legal residents of the U.S. and its territories, possessions and commonwealths who are 12 years of age or older, except employees and members of their households and immediate families (spouses, parents, siblings, children and each of their respective spouses) of Main Sponsor, SMART Carpet and Flooring, Inc. and all other participating contributors (collectively, the "Participating Product Contributors") and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local contributors. Winners must be 21 years of age to claim prize. Main Sponsor reserves the right to conduct a background check on any potential winner and reserves the right in its sole discretion to disqualify any person based on such background check if Main Sponsor determines in its sole discretion that awarding the prize to such potential winner might reflect negatively on Main Sponsor or any of the Participating Product Contributors. Entrants who have won a prize in any of The Ugly Floor Contest promotion in the ninety (90) days prior to the commencement of the Contest are ineligible. By entering, all participants and/or entrants release the Contest Entities and their respective parent companies, subsidiaries, and affiliates, and their respective agents, advertising and promotion agencies, affiliated companies, Contest partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages arising in connection with each entrant's participation and/or entry in the Contest and/or their receipt or use of any prize awarded in this Contest. Any and all warranties and guarantees are subject to the respective manufacturer's terms. This Contest is governed by U.S. law and is subject to all federal, state and local laws and regulations. Void outside the U.S. and where prohibited by law.
How Winner will be Determined: The eligible member with the most votes will be selected on August 31, 2012 by The Ugly Floor Contest. The ability to vote on a contest will be de-activated on August 31, 2012 at 11:59 p.m. ET. The winner will be contacted either in person or by overnight courier and phone on September 07, 2012. One vote per account allowed on each contest entry. Contest Administrator's decisions with respect to Winner and other matters pertaining to the Contest shall be final. The Winner may be required to sign an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, within five (5) days of issuance of prize notification. If Main Sponsor is unable to contact a potential prize winner within five (5) days of the initial attempt to contact, if a potential prize winner fails to complete and return all requested forms by the specified date or if a potential prize winner fails to comply with any of Main Sponsor's requirements or decisions, his/her prize will be forfeited, and an alternate prize winner shall be selected. By entering into the Contest, all entrants consent to the use of their name, photograph, likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law. The odds of winning the Prize depends upon the number of eligible entries received for the applicable drawing along with the number of votes cast on eligible entries.
The picture of the floor uploaded to the The Ugly Floor Contest website must exist at the addresses the new flooring is being installed. Entry materials that have been tampered with or altered are void. If, in the Contest Administrator's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, Contest Administrator reserves the right at their sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Contest, or to terminate the Contest and conduct a random drawing to award the Prize using all eligible, non-suspect entries received as of the termination date. Should the Contest be terminated prior to the stated expiration date, notice will be posted on the The Ugly Floor Contest Website. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Main Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event of a dispute as to the identity of the Prize Winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry.
Prize: One (1) Prize Winner will win the Prize, which will consist of the following: (i) Fifteen hundred dollars towards the purchase of new carpet, hardwood, laminate, vinyl or tile products available and installed by the Main Sponsor. In addition to free removal of the "Ugly Floor". If the winner is not within the servicable area of the main sponsor the winner will be issued a VISA gift card in the amount of $1,500.00. Restrictions apply to removal of existing floors.
Total of the Prize is $1,500.00
All costs, taxes, fees, and expenses associated with any element of a prize not specifically addressed above are the sole responsibility of the Prize Winner. All federal, state and local taxes on prize are the Prize Winner's responsibility. The Prize Winner will be issued a 1099 tax form for the Prize. The specifics of all aforementioned elements of the Prize in the Contest shall be solely determined by Main Sponsor. Some restrictions may apply. The Prize cannot be transferred, substituted or redeemed for cash except at Main Sponsor's sole discretion. Main Sponsor reserves the right to substitute any prize, or portions thereof, with a prize of comparable or greater value.
